ANHYDROUS AMMONIA PROGRAM The Anhydrous Ammonia program is a program that is jointly run between the North Dakota Department of Agriculture and the North Dakota Department of Insurance. The licensing and enforcement are the jurisdiction of the Department of Agriculture. The inspections are the jurisdiction of the Chief Boiler Inspector and his staff, with the Insurance Department. The primary responsibility for the program is to ensure that siting requirements are met, and the facility is designed to promote safe handling of anhydrous ammonia. Promoting safety through education and if needed enforcement is also a responsibility. ANHYDROUS AMMONIA LICENSE REQUIREMENTS To promote the safe operation of anhydrous ammonia facilities, licensing is done in order to identify and locate all anhydrous ammonia storage facilities in North Dakota and to inspect them to assure they meet existing standard for safety. Chapter 19-20.2-02 of the anhydrous ammonia law requires that any user or vendor of anhydrous ammonia owning or operating an anhydrous ammonia storage facility shall apply for an operator's license to the agriculture commissioner and the board of county commissioners of the county in which the facility is located. Chapter 19-20.2-03 of the anhydrous ammonia law states that no
anhydrous ammonia facility may be constructed or operated without a license
issued by the agriculture commissioner and the board of county commissioners
of the county in which the facility is located.
