NOTICE OF INTENT TO ADOPT ADMINISTRATIVE RULES

TAKE NOTICE that the Department of Agriculture will hold a public hearing to address proposed amendments of N. D. Administrative Code section 7-06-01-02 regarding the noxious weeds list. The public hearing will be held on November 1, 1999 in the Fort Totten Room at the State Capitol, Bismarck, at 10:00 a.m. CDT.
The purpose of the proposed amendment is to implement changes to Chapter 63-01.1 of the NDCC. The proposed rules address adding to the noxious weeds list diffuse knapweed (Centaurea diffusa Lam.), purple loosestrife (Lythrum salicaria L. virgatum and all cultivars), and yellow starthistle (Centaurea solstitialis L.); and deleting hemp (Cannabis sativa L.), hoary cress (Cardaria draba (L.) Desv.), and perennial sowthistle (Sonchus arvensis L.). The proposed amendment is not expected to have an impact on the regulated community in excess of $50,000.
The proposed rule may be reviewed at the office of the Department of Agriculture, 600 East Boulevard Avenue - Dept 602, State Capitol, Bismarck, ND 58505-0020. A copy of the proposed rules may be requested by writing the above address or calling (701) 328-2379. Written data, views, or arguments on the proposed rules sent to the above address or phone number and received by December 1, 1999 will be fully considered.

7-06-01-01. Weed control officer's certification. A weed control officer shall be certified upon completion of certification in two categories under North Dakota Century Code chapter 4-35. The two categories are agricultural pest control and right of way. A temporary certification may be issued for a period of one year to a weed control officer.

7-06-01-02. Noxious weeds listed. Weeds declared noxious shall be confined to weeds that are difficult to control, easily spread, and injurious to public health, crops, livestock, land, or other property. The following weeds have been declared noxious for the purpose of North Dakota Century Code chapter 63-01.1:

1. Absinth wormwood (artemisia absinthim). (Artemisia absinthium L.).

2. Canada thistle (cirs.ium arvense). (Cirsium arvense (L.) Scop.).

3. Field bindweed (convolvulus arvensis), also known as creeping
jenny. Diffuse knapweed (Centaurea diffusa Lam.).

4. Hemp (cannabis sativa), also known as marijuana. Field bindweed (Convolvulus arvensis L ).

5. Hoary cress (cardaria draba), also known as perennial
peppergrass or white top. Leafy spurge (Euphorbia esula L. ).

6. Leafy spurge (euphorbia esula). Musk thistle (Carduus nutans L.).

7. Musk thistle (carduus nutans). Purple loosestrife (Lythrum salicaria L. virgatum and all
     cultivars).

8. Perennial sowthistle (sonchus arvensis). Russian knapweed (Centaurea repens L.).

9. Russian knapweed (centaurea repens). Spotted knapweed (Centaurea maculosa Lam.).

10. Spotted knapweed (centaurea maculosalam). Yellow starthistle (Centaurea solstitialis L.)
